With NETFORCE Jobs, Companies have the opportunity to: post their vacancies, which will be available for viewing by all users of the Website, and receive responses to vacancies from Website users; find CVs in the CV database by various criteria, such as skills, experience, professions, cities, desired salary, and search queries; receive a list of CVs that may be of interest to the Company by e-mail; to carry out targeted mailing of its vacancies to the database of the Website's searchers; to improve the Company's profile on the Website by designing the profile in the corporate style, as well as to place the Company's logo on the Website. The Website services are paid. Payment for services is made in accordance with Art. 5 of these Terms. The procedure for providing the services provided for in paragraphs 4, 5, as well as the procedure for providing other information and advertising services, is additionally regulated by the Public Offer for the provision of information and advertising services available on the Website at: https://netforce.jobs/ .

These Terms are a legally binding agreement between you, the user who is looking for employees (hereinafter referred to as the 'Company'), and the owner of the Website, Netforce Agency LLC, registered at: 03124, Kyiv, 4 Vatslava Havela Boulevard, building 2, office 430 (hereinafter referred to as 'NETFORCE Jobs').
These Terms regulate the mutual rights and obligations of the Company and NETFORCE Jobs regarding the use of the Website and the services provided through it.
These Terms are a public offer and are considered fully accepted by the Company when put an electronic mark 'I have read and agree to the Terms of Use' while using the Website.

- to improve the Company's profile on the Website by designing the profile in the corporate style, as well as to place the Company's logo on the Website.
The Website services are paid. Payment for services is made in accordance with Art. 5 of these Terms.
The procedure for providing the services provided for in paragraphs 4, 5, as well as the procedure for providing other information and advertising services, is additionally regulated by the Public Offer for the provision of information and advertising services available on the Website at: https://netforce.jobs/.

Question 3

Procedure for registering a company on the website

Accepted Answer

To use all the functionalities and services of the Company's Website, you must register. The use of the Website services and registration on the Website means full and unconditional acceptance of these Terms.
Only business entities – legal entities or private entrepreneurs – are eligible to register as a Company. Private individuals (self-employed persons who are not entrepreneurs) cannot be registered as a Company.
To successfully register on the Website, the Company must fill in the appropriate registration form – the Company profile. To do this, the following fields must be filled in:
- Company name. In this field, you must specify the real name of the company without quotation marks, which corresponds to the name from the extract from the Unified State Register or corporate domain. It is forbidden to indicate the name of a company that does not exist, the name of another company, an abbreviation, a trademark without specifying the name of the company.
- EDRPOU code.
- Number of employees. In this field, you must specify the number of people working for the Company in Ukraine.
- Phone number. In this field, you must specify the phone number to contact your office.
- You can selectively specify the address of the company's website and its type.
- In addition, the Company may place its logo after registration on the 'Profile Settings' page in the following formats: JPG, GIF, PNG, BMP. The file size of the logo is up to 5 MB. The filled in fields in the account registration form must not contradict each other. In addition, the information provided in the fields must correspond to the information on the Company's website.
When registering on the Website, the Company is not allowed to:
- use someone else's address, e-mail address, or an address that the Company does not have the right to use;
- create multiple accounts on the Website;
- use the Website to distribute its own advertising materials;
- publish, under the guise of vacancies, announcements about job search services or staff recruitment services, partnerships, and cooperation, as well as about training courses, lectures, or masterclasses;
- publish offensive, deliberately false information, as well as information that may harm users of the Website and violate their rights;
- post information that contradicts the international treaties of Ukraine that have been concluded and duly ratified, as well as the current legislation of Ukraine.
NETFORCE Jobs does not allow the following companies to register:
- companies whose activities contradict the current legislation of Ukraine;
- companies that have submitted registration documents that do not comply with Ukrainian legislation, as well as documents issued by the 'LPR' and 'DPR' republics, which are not recognized in Ukraine; and/or issued by illegal authorities (officials) established in the temporarily occupied territory of Ukraine;
- companies that promote war, national hatred, change of the constitutional order or territorial integrity of Ukraine through violence, in particular, openly support the activities of illegal armed groups, Russian occupation forces, as well as militants and mercenaries on the territory of Ukraine.
NETFORCE Jobs reserves the right to establish criteria by which certain categories of employers are allowed to work with the Website (register on the Website and/or post vacancies).
NETFORCE Jobs monitors the IP addresses of the Companies while working with the Website and in case of doubts about the use of the same IP address by other Companies of the Website, NETFORCE Jobs has the right to block the possibility of using the Website by the Company without prior notice at its sole discretion until the doubts are resolved.
In addition, if there are doubts about the legality of the Company's actions, NETFORCE Jobs has the right to request a copy of the extract from the Unified State Register and a license for a particular type of the Company's activity, as well as to delete, block or change information about the Company at its discretion.
NETFORCE Jobs employees adhere to the principles of mutual respect and understanding. If Companies behave inappropriately toward NETFORCE Jobs employees, NETFORCE Jobs has the right to terminate access to vacancy postings based on the assumption that the Company may behave inappropriately toward job applicants.
The Company is prohibited from collecting information in any way from the CV database of the website https://netforce.jobs/ and/or contact information of users of the website https://netforce.jobs/ in order to transfer the information collected in this way to third parties.
The company is prohibited from using the CV database of the website https://netforce.jobs/ and/or contact information of users of the website https://netforce.jobs/ to send SMS messages not related to employment within the Company's enterprise/institution/organization.
In case of failure to fulfill these obligations, violation of these Terms or the current legislation of Ukraine, NETFORCE Jobs has the right to take all necessary measures to stop the violation, including temporarily blocking the Company's access to the Site. NETFORCE Jobs has the right not to explain the reasons for blocking the Company's account.

Question 4

Procedure for publishing vacancies on the website

To publish a vacancy on the Website, the Company must fill out the appropriate form on the Website, following simple guidelines.
A vacancy announcement must contain information about only one vacancy. The Company may not place several identical advertisements (advertisements with the same semantic content) at the same time.
All fields of the form must be filled in in accordance with their name and semantic purpose, in accordance with the rules of spelling, punctuation, style, without unnecessary abbreviations and obscene vocabulary.
In the 'Title' field, you must specify the job title: the first letter is capitalized. The job title must correspond to the position title and not contain unnecessary information. The job title must be written in the same language.
In the fields 'About the vacancy', 'Requirements', 'Will be a plus', 'We offer', you must fully describe the essence of the offer in accordance with the field name. Be sure to include job responsibilities, requirements for the applicant, and working conditions. The job description must match the job title. The job description must be written in one language; duplication of the job description in different languages is not allowed. It is prohibited to mechanically transcribe the text or individual words by means of transliteration.
The amount of payment is indicated in US dollars.
In the 'Location' field, you must specify the regions in which the vacancy is open. If the vacancy involves remote employment, you can specify any region (the vacancy will be visible to users from the corresponding region). In addition, if the employer guarantees free accommodation or the job requires relocation from one region to another, you should select the 'Relocate' option. It is forbidden to post vacancies on the website in the territories temporarily not controlled by Ukraine.
All vacancies will be available for viewing by all users of the Website, as well as information about the Company that posted this particular vacancy.
The following vacancy announcements are not allowed to be posted:
- if their activities contradict the current legislation of Ukraine;
- with investing in any projects and the possibility of quick enrichment;
- not related to the direction of the platform (DevOps and related technical areas).
In addition, such vacancy announcements are not allowed to be posted:
- job offers that do not correspond to the Company's business;
- advertisements, cooperation offers that do not involve employment;
- advertisements offering paid telephone numbers for communication, as well as advertisements requiring payment from the Website users for employment;
- vacancies offering remote work without specifying the necessary contact information;
- vacancies containing information that contradicts the legislation of Ukraine;
- vacancies of commercial organizations on behalf of government agencies and non-profit organizations;
- vacancies that contain offensive, deliberately false information or information that may harm users of the Website and violate their rights, including false information about the position offered or the nature of the Company's activities.
An employer who indicates in a vacancy announcement any discriminatory restrictions: (for example, age restrictions for candidates, job offers to women only or men only, requirements that give preference to women or men, representatives of a certain race, skin color, requirements regarding political, religious and other beliefs, membership in trade unions or other associations of citizens, ethnic and social origin, property status, place of residence, language or other characteristics), and also requires information about the candidates' identity or requires information about a candidate's personal life does so at his or her own risk and confirms that he or she is familiar with the requirements of applicable law (in particular, paragraph 3 of Art. 11 of the Law of Ukraine 'On Employment of the Population' and Art. 24-1 of the Law of Ukraine 'On Advertising').
All vacancies posted on the Website are checked by the Website administration. NETFORCE Jobs reserves the right to make changes and corrections to the title and text of the job in order to increase the effectiveness of the posted jobs, including the right to remove unnecessary information from the title and text of the ad, leaving the essence of the offer. NETFORCE Jobs may request the Company to describe in more detail any sections of the job posting, including the requirements for the candidate, duties, working conditions, etc.
In addition, NETFORCE Jobs has the right not to allow the publication of vacancies on the Website that contradict these Terms of Use and the legislation of Ukraine. In case of significant violations of these Terms, NETFORCE Jobs shall suspend the publication of vacancies with the explanation in the Company's account (at the discretion of NETFORCE Jobs).

Payment procedure for the services of the Website

NETFORCE Jobs publishes a list of its services on the Website, including a description of such services and information about their cost. The Company has the right to order and receive NETFORCE Jobs services by selecting the desired service on the Website.
The company is obliged to pay for the services of NETFORCE Jobs. Payment is made in a non-cash form by bank transfer or bank cards Visa, MasterCard.
Payment shall be made by the Company to the NETFORCE Jobs account and shall be deemed to be made upon receiving the funds to the NETFORCE Jobs account.
In case of blocking the Company's account, payments for the services actually provided are not refundable.

Question 7

Intellectual property rights

The Company acknowledges and agrees that all content and materials available on the Website are protected by, but not limited to, copyright, trademarks, and trade secrets. Reproduction, copying or distribution for commercial purposes of any materials or elements of the Website without the prior permission of NETFORCE Jobs is strictly prohibited.
In addition, the Company grants NETFORCE Jobs a perpetual, non-exclusive right to publicly display the Company's trademarks and/or logos by placing them on the Website (until the Company withdraws such consent).

Question 8

Disclaimer of Warranties and Limitation of Liability

Accepted Answer

The Company agrees that it uses the Website as it is. NETFORCE Jobs does not warrant that the operation of the Website will be uninterrupted, error-free or free of malware or other defects. If the Company is not satisfied with the terms and/or quality of the Website, it may stop using the Website or contact the Website Support Service.
NETFORCE Jobs shall not be liable for any damages arising from the disruption of the Website, as a result of its use or inability to be used by the Company.
NETFORCE Jobs is not responsible for the content of the materials published by the Company, as well as for the facts of violation of Art. 11 of the Law of Ukraine 'On Employment' and Art. 24-1 of the Law of Ukraine 'On Advertising' by the Company.

Question 9

Responsibility of the parties

For non-fulfillment or improper fulfillment of their obligations under these Terms, the parties to these Terms shall be liable in accordance with the current legislation of Ukraine.
The Company undertakes not to violate or attempt to violate the provisions of these Terms. If NETFORCE Jobs, at its sole discretion, determines that the User has violated or attempted to violate these Terms, the Company's access to the Website may be terminated.
The Company agrees to indemnify and hold NETFORCE Jobs harmless from any claims or demands from any third parties in connection with and/or as a result of the Company's violation of these Terms, the current legislation of Ukraine or the rights of third parties.

Changes and additions

Accepted Answer

NETFORCE Jobs has the right to amend or supplement these Terms at any time without any special notice by posting a new version of the Terms on the Website. The new version of the Terms comes into force from the moment it is posted on the Website, unless otherwise provided by the new version of the Terms.
